Site Visits

These Terms and Conditions came in operation from September 2017.

They are occasionally amended and nurseries will issue the latest version for your review and agreement.

Nursery Places and Bookings

A signed and fully completed application form must be received by the Company before a place can be considered. Full and part time sessions must fit in to the session times as defined for the Nursery of choice; however, we will attempt to meet individual needs where necessary. We will not confirm a booking more than 2 months prior to the start date.

Registration Fees and Deposits

A £50 non-refundable registration fee is required upon booking a place. This is payable at time of registration, for fee paying children ONLY. For Fully Funded Extended Hours places there is a £50 refundable deposit and is used to secure the childs place and when funding has been secured it will be refunded or credited to the account if charges have been applied to the account. If a child starts and is unable to meet the criteria for the respective funding then this will be applied to the account against childcare costs.

Fees and Invoices

The first invoice will be issued either before or during the child's first week in the Nursery and will charge up to the end of the current invoiced month. This invoice is payable immediately by Card, Bank Transfer or cash. Thereafter, a £10 administration cost will be levied each month if payments are not made by Electronic means. If payments are cancelled or returned by the Bank, a fee of £50 will be charged to cover costs incurred by the Company. We no longer accept cheques

All invoices will be issued prior to the invoice period (these are based on 4 or 5 weeks, timetables are available) they apply to and are calculated on the booked attendance for the forthcoming period. Extra sessions or additional charges will be invoiced in arrears.

All invoices are due for payment within 7 days of issue. Failure to adhere to this may result in a 10% surcharge of Invoiced value, for late payment being applied to your account. If for any reason you experience difficulties in paying please speak to the Nursery Manager as soon as you can to arrange a payment plan or schedule.

Other than if we are in breach of these Terms and Conditions, all sessions booked must be paid for, regardless of whether the child attends. No refunds will be given for sessions missed due to holidays, sickness or Bank Holidays. Failure to meet payments will result in the termination of the Nursery place. We reserve the right to charge interest at 5% above the Bank of England's base rate on outstanding fees. We are not liable for collection from third parties, e.g. colleges, grant funding, voucher providers etc. The parent/carer remains responsible for all outstanding fees. If you default on payment, we reserve the right to pass the debt to our debt collection agent Daniel Silverman, who will seek to recover all debt collection charges in addition to any debt incurred with us.

The late collection charge is £10 for the first 15 minutes, and £20 for every 15 minutes or part of thereafter - this is at the discretion of the Nursery Manager

A minimum of four weeks’ notice will be given before any fee increase is implemented.

Funding and Additional Services

Funded hours will be allocated from the cheapest hours on our pricing structure for your booking pattern. Additional hours if not fully meeting defined sessions will be charged at the prevailing Hourly rate, rather than at a proportional session rate.

We will allow the Universal 15 hours for 38 weeks for 2, 3 & 4 year olds to be stretched to 11 hours for 52 weeks. The conditional extended 15 Hours for 3 & 4 year olds we will only accept on a Term Time basis due to the complexity of managing the agreements around these hours.

Nursery Closure

The Nursery is closed on all Bank Holidays, including Christmas Day, Boxing Day and New Years Day. Normal charges will apply for sessions booked on these days, including any booked funded sessions.

Termination / Cancellation / Change

We require one month’s notice, in writing, should a Nursery place wish to be terminated for any reason. Parents remain liable for fees throughout the notice period. If a parent withdraws their child during this notice period, the fees shall remain payable. We reserve the right to terminate a Nursery place with immediate effect and if necessary, the reason will be put in writing to the parent.

If a start date is postponed by the parent for any reason, we reserve the right to charge from the original start date stated on the application form, or confirmed with the Nursery.

If a parent wishes to change the number of sessions taken at Nursery, one month’s notice, in writing, must be given and a 'Change of Sessions' form must be completed and handed in at the Nursery Office.

Personal Property and Belongings

We cannot be held responsible for any loss or damage to children's property. Every reasonable effort will be made by Nursery staff to ensure the children's belongings are not lost or damaged.

Practical 'inexpensive' clothing is strongly recommended for children attending Nursery. It is the parent's responsibility to name and clearly label all items of clothing.

We suggest that all toys, books or other equipment is left at home.

Liability

We accept no responsibility for any loss suffered by parents, arising directly or indirectly, because of the Nursery being temporarily closed or the non-admittance of your child to the Nursery for any reason, this applies to absence due to sickness, holidays and Bank Holidays. We accept no responsibility to children whilst in their parents care on Nursery premises, i.e. prior to arrival or after picking up.

Our liability shall be limited to the amount received by us, for the claim under the Insurance Policy covering such risks. Any delay in notifying us of any claim, may prevent the parent recovering any money under any such policy.

We will not be liable to parents and/or children for any economic loss of any kind, for damage to the child's or parent’s property, for any loss resulting from a claim made by any third party or for any special, indirect or consequential loss or damage of any kind.

We will make reasonable endeavours to keep parents and/or children's property in good order. Liability for damage of such property is excluded except where caused by our negligence.

Insurance

We have extensive Insurance cover. Insurance certificates are displayed in our entrances.

Behaviour Management

We may require parents to withdraw or remove their child from the Nursery if the Nursery Manager considers the child to be disruptive or displaying inappropriate behaviour.

We will not tolerate Nursery staff being spoken to in an abusive or threatening manner by parents, carers or children. Such behaviour may result in the termination of a Nursery place.

Accidents and Illness

We reserve the right to administer basic first aid and treatment when necessary. Parents will be informed of all accidents and will be required to sign an accident form. For accidents of a more serious nature, involving hospital treatment, all attempts will be made by Nursery to contact the parents, but failing this, we are hereby authorised to act on behalf of parents and authorise necessary treatment.

We will administer prescribed medicines if parents complete a 'Medicine Consent' form; however, the first dose of medicine must be given at home and parents must take all medicines home at the end of each day.

We may require parents to withdraw their child from Nursery, in the event that they require special medical care or attention, which is not available or refused by parents or it is considered that the child is not well enough to attend Nursery. We may also ask parents to withdraw their child from Nursery, if we have reasonable cause to believe that they are or maybe suffering from or has suffered from any contagious disease/infection and there remains a danger that other children at the Nursery may contract such a disease/infection. We accept no responsibility for children contracting contagious diseases/infections. Please refer to our Communicable Disease policy regarding incubation and exclusion periods. Parents are requested to inform Nursery if their child is suffering from any illness, sickness or allergies before attending Nursery.

We have a realistic attitude to the needs of working parents but we reserve the right to contact parents if their child becomes ill during Nursery hours.

Security

Under no circumstances will the child be allowed to leave the Nursery with anyone unknown to the Nursery staff unless the parent has previously arranged this. If a parent has made alternative arrangements by telephone, the Nursery will require the name, address and telephone number of the person permitted to collect the child and proof of identity will be required upon arrival at the Nursery. A list of responsible adults who are authorised to collect the child should be given to the Nursery Manager.

Data Sharing with Local Authorities/Agencies

Due to the need for confirming both parental and child data with local authorities and agencies for funding and to obtain key services to assist children, we will share information about parents/carers and children. If you wish to opt out please contact the Nursery Manager to discuss further.

General Information

Parents are requested to inform the Nursery of any food, medicine, activity or any other circumstances that may cause the child to have an allergic reaction or show signs of an allergy. Parents must provide details, in writing, of the severity of the reaction or allergy and must continue to inform the Nursery of any changes, or progress, to the condition, in writing, when they become aware. Parents are requested to inform the Nursery of any changes to all information kept at the Nursery.

Parents agree that they shall not at anytime, whether throughout the continuance of this agreement or for a period of six months after its termination, directly or indirectly (via agencies) employ/entice away an employee with whom they have had contact or dealings with at the Nursery. If a parent does directly or indirectly employ a member of staff, 25% of salary may be payable.

We may require parents to withdraw or remove their child from Nursery, if the parent is not completely honest about the child's condition or withholds or is found to have withheld important information.
